1. Who we are

BidPage ("BidPage", "we") is operated by MEDUSH LTD, a company registered in the United Kingdom. Contact: support@bidpage.app. By creating an auction or placing a bid you agree to these Terms.

2. What BidPage is (and is not)

BidPage is a software tool that lets a seller create an auction page for a digital item or service and lets bidders place bids. The sale contract is between the seller and the winning bidder. BidPage is not a party to that contract, does not own or verify the items sold, and does not act as an escrow service, auctioneer, or agent for either party. Payments are processed by Stripe; sellers receive funds through their own Stripe account.

3. Auction rules

  1. The seller chooses the auction format before publishing: Open (visible bids, winner pays their winning bid), Private (sealed bids, winner pays their own bid), or Fair Price (sealed bids, winner pays the second-highest bid).
  2. Bidders must save a valid payment method before a bid counts.
  3. All bids are binding. A bid is a commitment to pay up to the bid amount under the chosen format's rules if you win.
  4. In sealed formats, a bidder may revise their single bid until closing. In open auctions, bids may only be raised, subject to the minimum increment.
  5. The winner pays the greater of the format's resulting price or the seller's reserve. With a single qualifying bidder, the price is the reserve. Exact ties are won by the earliest bid.
  6. Bids placed in the final two minutes of an open auction may extend the closing time (anti-sniping).
  7. The seller may not cancel an auction after the first valid bid, and may not bid on their own auction directly or through others.
  8. If a Buy Now price is set and used, the auction ends immediately at that price.
  9. At closing, the winner's saved card is charged automatically. If the charge fails, the winner has 12 hours to pay manually; after that, the item may be offered to the next eligible bidder or the auction marked unsold.

4. Fees

Creating an auction and bidding are free. On a completed sale, BidPage charges the seller a platform fee of 2% of the final price (minimum $1, maximum $29); sales under $10 are free.

A payment-processing fee is also deducted from the seller's payout at a published rate of 2.9% + $0.30 per completed sale. This is our published rate, not a pass-through of the amount our payment processor charges us for any individual transaction, which varies with the card used and may be higher or lower. Both deductions are shown to the seller before an auction is created, and the payout figure quoted there is the amount actually transferred. Losing bidders pay nothing. The platform fee is non-refundable once a transaction succeeds, except where the law requires otherwise.

5. Delivery, refunds and chargebacks

  1. The seller must deliver the item as described, within the delivery window stated on the auction page, and must be able to evidence delivery.
  2. No refunds for change of mind. Completed sales of delivered digital items are final.
  3. If the seller cannot or does not deliver, the buyer is entitled to a refund of the price paid. Sellers are responsible for issuing such refunds via Stripe.
  4. Card-network chargeback rights and mandatory consumer-protection laws are unaffected by these Terms. Where a buyer receives immediate delivery of digital content, the buyer acknowledges at checkout that any statutory cancellation right may be lost once delivery begins.
  5. Sellers are liable for disputes and chargebacks arising from their auctions and authorise recovery of associated amounts from their Stripe balance.

6. What may not be sold

No illegal items or services; no items you do not control or lack the right to sell; nothing that infringes intellectual-property rights; no accounts, usernames or placements whose transfer or sale violates the rules of the platform they belong to; no financial products, personal data, sexual services, weapons, drugs, counterfeits, or anything on Stripe's prohibited-business list. We may remove any auction and suspend any user at our discretion, including where fraud or rule-violations are suspected.

7. Seller and bidder responsibilities

You are responsible for the accuracy of what you publish, for your own taxes, and for complying with the laws that apply to you. Sellers warrant that they control the asset offered and that its proof link is genuine.

8. Liability

BidPage provides the tool "as is". To the maximum extent permitted by law, our total liability to any user is limited to the platform fees that user paid us in the 12 months before the claim. We are not liable for the conduct of sellers or bidders, for items sold, for lost profits, or for indirect losses. Nothing limits liability that cannot lawfully be limited.

9. Changes and termination

We may update these Terms; material changes will be posted on this page with a new date and apply to auctions created after that date. We may discontinue the service; auctions already closed will be settled under the rules in force when they closed.

10. Law and disputes

These Terms are governed by the laws of England and Wales, and disputes with us belong to the courts of England and Wales — except that consumers keep any mandatory protections and venue rights of their country of residence.
